De lograrse la petici\u00f3n, pasar\u00eda de estar acusado por homicidio en concurso homog\u00e9neo en modalidad de dolo eventual a t\u00edtulo de autor material por el delito de homicidio culposo. <\/p> \n <p> Desde el 19 de noviembre de 2021, Vives se encuentra en detenci\u00f3n domiciliaria despu\u00e9s de estar 3 meses detenido en una c\u00e1rcel. De ser hallado culpable por el delito de homicidio culposo pagar\u00eda solo 2 a\u00f1os m\u00e1s, una pena que podr\u00eda seguir purgando en su vivienda. El penalista Alex Fern\u00e1ndez es un influyente abogado del Magdalena, adem\u00e1s de defender a Vives, ha defendido a la familia Cotes, especialmente a \u00c1lvaro Cotes Vives.
